Terms of Service

Welcome to CB’s Pontoon Boat Rentals & Cruises. These Terms of Service (“Terms”) govern your use of our website, reservation process, rental services, captained cruises, and related services offered by CB’s Pontoon Boat Rentals & Cruises (“CB’s,” “we,” “our,” or “us”).

By using our website, making a reservation, paying a deposit or rental fee, participating in a rental, operating one of our vessels, joining a captained cruise, or otherwise using our services, you agree to these Terms. If you do not agree with these Terms, please do not use our website or services.

1. Scope of These Terms

These Terms apply to:

Use of our website; Reservations and bookings; Deposits and payments; Self-operated pontoon boat rentals; Captained cruises; Passenger conduct; Safety rules and operator requirements; Damage, cleaning, late return, and other charges; Cancellations, rescheduling, and weather-related changes.

These Terms supplement any separate rental agreement, liability waiver, safety acknowledgment, or other document signed or accepted before or during your rental or cruise. If there is a conflict between these Terms and a signed rental agreement or waiver, the signed agreement or waiver will control for matters directly related to vessel use, damage responsibility, safety rules, liability, and assumption of risk.


2. Reservations and Payments

Reservations may require payment of a deposit and/or rental fees. Payments may be made online, over the phone, or in person.

A reservation is not confirmed until CB’s Pontoon Boat Rentals & Cruises has received the required deposit or payment and has accepted the booking.

We reserve the right to correct pricing errors, booking errors, availability errors, or other mistakes on the website or in the reservation process. If an error affects your reservation, we will make reasonable efforts to contact you.


3. Deposits

A deposit may be required to reserve a rental or cruise date and time.

Unless otherwise stated in writing by CB’s, deposits are non-refundable. Deposits may be transferable or rescheduled only in accordance with these Terms and any applicable booking policies provided at the time of reservation.

Failure to appear for a scheduled rental or cruise may result in forfeiture of the deposit and any amounts paid.


4. No Refunds; Rescheduling Only

All rental and cruise payments are subject to a no-refund policy.

If a reservation needs to be changed, the customer may request to reschedule. Rescheduling arrangements must be made within 30 days of the original rental or cruise date.

Rescheduling is subject to availability, weather conditions, vessel availability, staffing, and approval by CB’s Pontoon Boat Rentals & Cruises.


5. Weather Policy

Safety is a priority. Weather conditions may affect rentals and cruises.

For self-operated rentals, either the customer or CB’s may determine that weather conditions make the rental unsafe or unsuitable. Examples may include heavy rain, high winds, gusty conditions, lightning, severe weather advisories, unsafe water conditions, or other circumstances that create safety concerns.

When weather requires a change, the reservation may be rescheduled in accordance with our rescheduling policy. No refunds will be issued.

For captained cruises, weather-related rescheduling is at the discretion of CB’s Pontoon Boat Rentals & Cruises. The captain and/or CB’s may make final decisions regarding safety, route, timing, itinerary changes, delay, cancellation, or rescheduling due to weather or water conditions.


6. Damage Deposit and Authorization Hold

A credit card authorization hold or damage deposit may be required before a rental or cruise. This hold is intended to cover potential damage, excessive cleaning, missing equipment, unpaid charges, late returns, fuel-related charges, lost rental time, rule violations, or other amounts owed under these Terms or the rental agreement.

CB’s may deduct or charge amounts for, including but not limited to:

Damage to the vessel, motor, propeller, furniture, equipment, safety gear, dock, or related property; Excessive cleaning; Missing or damaged equipment; Late returns; Fuel-related charges, if applicable; Towing, recovery, service calls, or rescue-related costs caused by customer conduct; Lost rental time caused by damage, late return, unsafe operation, or violation of rules; Fines, penalties, or fees resulting from customer or passenger conduct.

Authorization holds are typically released after the rental is complete and the vessel has been inspected, but the timing of release may depend on the customer’s bank or card issuer.


7. Operator Requirements

All operators of a self-operated rental vessel must meet CB’s operator requirements.

Each operator must:

Be at least 30 years old; Have boating experience; Provide a valid driver’s license; Possess, obtain, or otherwise comply with applicable California Boater Card requirements; Follow all safety instructions, boating laws, posted rules, and instructions from CB’s.

The primary renter does not necessarily need to operate the vessel, but the primary renter remains responsible for ensuring that every operator meets these requirements. The primary renter is also responsible for the conduct of all operators and passengers in their party.

CB’s may refuse to allow any person to operate a vessel if, in our judgment, the person does not meet the requirements, appears impaired, lacks sufficient experience, refuses safety instructions, or presents a safety risk.


8. Customer and Passenger Responsibility

The primary renter is responsible for themselves, all operators, all passengers, and all activity associated with the rental or cruise.

Customers and passengers must:

Follow all safety instructions; Comply with all applicable boating laws and regulations; Use reasonable care around the vessel, dock, equipment, and other people; Avoid unsafe, reckless, illegal, or disruptive conduct; Follow capacity limits and instructions provided by CB’s; Respect other boaters, marina staff, property owners, and the surrounding community.

CB’s may end a rental or cruise early, refuse departure, require return to dock, or deny future service if customer or passenger conduct creates a safety issue, violates these Terms, violates the rental agreement, damages property, disrupts others, or creates risk to people or property.

No refunds will be issued for rentals or cruises ended early due to misconduct, unsafe behavior, impairment, rule violations, or failure to follow instructions.


9. Alcohol and Impairment

Alcohol may be permitted for passengers who are legally allowed to consume alcohol, subject to applicable laws and CB’s rules. However, no operator may operate a vessel while impaired by alcohol, drugs, cannabis, medication, or any other substance.

Boating under the influence is prohibited by law and is strictly prohibited by CB’s.

CB’s reserves the right to refuse service, prevent departure, remove an operator, end a rental or cruise, or require the vessel to return to dock if any operator appears impaired or if alcohol or substance use creates a safety concern.

Customers are responsible for ensuring that all members of their party comply with alcohol, boating, and safety laws.


10. Captained Cruises

Captained cruises are operated under the authority and discretion of the captain and CB’s Pontoon Boat Rentals & Cruises.

For captained cruises:

The captain has final authority over safety decisions; The captain may change the route, itinerary, timing, speed, or destination for safety, weather, water conditions, operational reasons, or passenger conduct; Passengers must follow all captain instructions; Unsafe, disruptive, intoxicated, aggressive, or unlawful behavior may result in refusal of service or early termination of the cruise; Weather-related rescheduling is at CB’s discretion.

No refunds will be issued for captained cruises that are shortened, modified, or ended due to passenger misconduct, unsafe behavior, refusal to follow instructions, or other violations of these Terms.


11. Right to Refuse or Discontinue Service

CB’s Pontoon Boat Rentals & Cruises reserves the right to refuse, cancel, discontinue, or limit service when permitted by law and when we determine, in our professional judgment, that doing so is appropriate.

This may include, but is not limited to, situations involving: Safety concerns; Weather or water conditions; Failure to meet operator requirements;

Suspected impairment; Refusal to follow instructions; Abusive, threatening, disruptive, or unlawful conduct; Fraudulent, incomplete, or inaccurate booking information; Prior damage, unpaid balances, or prior rule violations; Any circumstance that may place people, property, vessels, staff, passengers, or the public at risk.

CB’s does not refuse service for unlawful discriminatory reasons. Service decisions are made for legitimate business, safety, operational, legal, or conduct-related reasons.


12. Assumption of Risk

Boating and water-related activities involve inherent risks. These risks may include, but are not limited to, slips and falls, dock hazards, changing weather, waves, wakes, collisions, equipment failure, drowning, injury, property damage, and risks caused by other boaters or passengers.

By participating in a rental or cruise, you understand and accept that these risks exist. You are responsible for exercising care, following instructions, using good judgment, and ensuring that your group complies with all safety requirements.

Additional assumption-of-risk, liability waiver, and indemnity terms may be included in a separate rental agreement or waiver.


13. Damage, Loss, and Cleaning

Customers are responsible for returning the vessel and equipment in the same general condition in which they were provided, ordinary wear and tear excepted.

Customers may be charged for damage, excessive cleaning, missing equipment, late returns, recovery, towing, service calls, lost rental time, or other costs caused by the customer, operators, passengers, guests, or violations of these Terms or the rental agreement.

CB’s will determine damage, cleaning needs, missing items, and related charges in good faith based on inspection, repair estimates, replacement costs, staff time, vendor costs, and lost rental availability.


14. Late Returns

Vessels must be returned at the scheduled time unless CB’s gives prior approval.

Late returns may result in additional fees, lost rental time charges, staff overtime charges, or other costs. Late returns may also impact other customers and may result in refusal of future service.

No refund or credit will be provided for late departure caused by customer delay, incomplete paperwork, failure to meet operator requirements, late arrival, or failure to complete required safety procedures.


15. Customer Information and Booking Accuracy

Customers agree to provide accurate, current, and complete information when making a reservation or using our services.

CB’s may cancel or refuse a reservation if information is inaccurate, incomplete, fraudulent, misleading, or if required documentation is not provided.

Customers are responsible for ensuring that their contact information is accurate so CB’s can communicate booking updates, weather issues, safety information, and rescheduling options.


16. Website Use

You may use our website only for lawful purposes and in accordance with these Terms.

You agree not to:

Attempt to interfere with website operation or security; Use the website for fraudulent or unlawful purposes; Copy, scrape, or misuse website content; Submit false or misleading information; Attempt to gain unauthorized access to any system or account.

We may update, modify, suspend, or discontinue any part of the website at any time without notice.


17. Website Content and Availability

We make reasonable efforts to keep website information accurate and current. However, pricing, availability, policies, vessel details, schedules, and services may change without notice.

Website content is provided for general informational purposes and does not guarantee availability, pricing, or specific rental conditions unless confirmed directly by CB’s.


18. Intellectual Property

All website content, including text, images, graphics, logos, branding, layout, and other materials, is owned by or licensed to CB’s Pontoon Boat Rentals & Cruises unless otherwise stated.

You may not copy, reproduce, modify, distribute, or use our website content for commercial purposes without written permission from CB’s.


19. Limitation of Liability

To the fullest extent permitted by law, CB’s Pontoon Boat Rentals & Cruises will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from use of our website, reservations, rentals, cruises, vessel operation, passenger conduct, weather, water conditions, third-party conduct, or inability to use our services.

Nothing in these Terms is intended to limit liability where such limitation is prohibited by law.

Additional liability limitations may be included in a separate rental agreement or waiver.


20. Indemnification

You agree to defend, indemnify, and hold harmless CB’s Pontoon Boat Rentals & Cruises, its owners, employees, contractors, captains, agents, and representatives from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney’s fees, arising out of or related to:

Your use of our website or services; Your reservation, rental, or cruise; Operation of a vessel by you or your group; Conduct of your operators, passengers, guests, or invitees; Damage to property; Injury to any person; Violation of these Terms, the rental agreement, safety rules, or applicable law.


21. Privacy

Use of our website and services may involve the collection of personal information. Please review our Privacy Policy for information about how we collect, use, and protect personal information.


22. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.


23. Changes to These Terms

CB’s Pontoon Boat Rentals & Cruises may update these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date.

Your continued use of our website or services after changes are posted means you accept the updated Terms.
